Pot charge dropped against 49ers LB Foster

The Tuscaloosa County (Ala.) District Court confirmed Friday that a misdemeanor marijuana charge against 49ers linebacker Reuben Foster had been dismissed on the condition that he pay court costs.

The misdemeanor marijuana charge against 49ers LB Reuben Foster has been dismissed, the district court in Tuscaloosa County confirmed Friday afternoon. Foster must pay court costs, which includes a $100 bail bond fee. Foster had two felony charges related to domestic violence against him dismissed on Wednesday.

Linebacker Reuben Foster rejoined the 49ers on Thursday, the team confirmed. Foster was welcomed back after felony charges of domestic violence against him were dismissed on Wednesday.

49ers OT Joe Staley on Reuben Foster having two charges related to domestic violence dismissed today and Foster's impending return to the team on Thursday: "(I'm) excited to see him come back whenever he comes back to the building and give him a hug and move forward,” Staley said.

49ers are holding their "state of the franchise" event tonight in San Jose only hours after domestic violence charges against LB Reuben Foster were dismissed a few miles down the road. Kyle Shanahan, John Lynch, members of their staff and some players are scheduled to appear.

With domestic violence charges against him dismissed Wednesday afternoon, 49ers linebacker Reuben Foster can re-join the team on Thursday, according to a statement from GM John Lynch. "The organization is aware the domestic violence charges against Reuben Foster were dismissed earlier today," Lynch said. "As a result, he will have the opportunity to rejoin the team tomorrow. It has been made clear to Reuben that his place on this team is one that must continue to be earned. We will continue to monitor the remaining misdemeanor charge.”

Judge Nona L. Klippen cited insufficient cause to believe either charge related to domestic violence against Reuben Foster rose to the level of probable cause. Klippen made multiple references to a lack of evidence throughout her statement. Thus, both charges were dismissed.

The gun charge against Reuben Foster has been reduced to a misdemeanor. The pre-trial for that case is set for June 6 at 9 a.m.

Today is a big day on a number of levels (and in varying degrees of importance) for the 49ers. This morning, owner Jed York abstained from voting on the league's new national anthem policy because he wants to hear more from players. This afternoon, linebacker Reuben Foster's legal situation should get some clarity as a Santa Clara County judge rules on whether any or all of the three felonies against him will proceed to trial. And tonight, the team will hold its "state of the franchise" event, where it is expected to unveil a new alternate or throwback uniform.

49ers owner Jed York abstained from voting today on the NFL's new anthem policy. The owner of the team that employed Colin Kaepernick and Eric Reid told reporters: "I think there are a lot of reasons, and I'm not going to get into all of those reasons. But I think the gist of it is really that we want to make sure that everything that we're doing is to promote progress. And I think we've done a good piece of that so far."

Offensively, running back Jerick McKinnon was one of Tuesday's brightest performers at 49ers OTAs. McKinnon was particularly active as a pass catcher as he and QB Jimmy Garoppolo hooked up for at least a pair of big plays. It's early but it's safe to expect the Niners to use McKinnon in the passing game quite a bit in 2018.

Among the 49ers not participating in Tuesday's OTA session: CB Richard Sherman (achilles), WR Trent Taylor (back), G Jonathan Cooper (knee) and LB Brock Coyle (shoulder). With Sherman out, Jimmie Ward and Ahkello Witherspoon worked with the first team defense at cornerback. And with Cooper out, Joshua Garnett worked with the first team offense at right guard.

The 49ers wasting no time getting rookie Mike McGlinchey in with the first team. He took the bulk of the work at right tackle and held up fine during the OTA.

With Reuben Foster awaiting resolution to his legal situation, the 49ers rolled with veterans Malcolm Smith and Korey Toomer with the first team defense at the two inside linebacker spots. Smith appeared to be handling the calls in the huddle. No surprise, he's the team's most experienced LB in this scheme.

While the Niners aren't in pads during OTAs, they got some strong inside pass rush work from DL Solomon Thomas during one on ones. Thomas won four straight reps against the first and second team offensive line.

New 49ers CB Richard Sherman (Achilles) isn't playing football during these OTAs but don't let it be said he's not participating. Sherman did some work on the side and then was all over the field offering guidance to the young defensive backs during the session.
